Terms of Service

You must be at least 18 years old to use the Service. By using it, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

PoseLab is an AI-powered headshot generation service. You upload selfies ("Input Photos"), and our system uses them as visual references to generate professional portrait images ("Generated Images") across a set of curated styles. The number of Generated Images you receive depends on the pricing tier you purchase.

Generative AI is probabilistic by nature. Individual results vary based on the quality, variety, and content of your Input Photos. We do not guarantee any specific level of likeness, quality, or suitability for any particular purpose. We strongly encourage you to review our photo upload guidelines before purchasing to maximize your results.

All purchases are processed through Stripe. By providing your payment details, you authorize us to charge the amount displayed at checkout. Prices are in USD and include all applicable taxes where required by law.

Once payment is confirmed, we will send a unique upload link to the email address you provided. Your order is complete when your Generated Images are delivered to your private gallery. We do not offer subscriptions; each purchase is a one-time transaction.

We want you to be satisfied with your headshots. If you are unhappy with the results:

• Email hello@poselab.io within 14 days of your order with a brief description of the issue.
• We will first offer a free retry — we'll retry the style you're unhappy with using adjusted prompts at no additional charge.
• If the retry still does not meet your expectations, we will issue a full refund to your original payment method within 5–10 business days.

Refund requests made after 14 days, or for orders where the Input Photos did not meet our upload guidelines (e.g., group photos, obscured faces, or heavily filtered images), may not be eligible for a full refund at our sole discretion.

You agree that you will not use the Service to:

• Upload photos of any person without their explicit consent.
• Upload photos of anyone under the age of 18.
• Impersonate another real person or create deceptive content.
• Generate content intended to harass, defame, or harm any individual.
• Attempt to circumvent any technical measures or access any part of the Service beyond your authorized order.
• Use the Service for any unlawful purpose or in violation of any applicable law.

We reserve the right to cancel any order and refuse service, without refund, if we reasonably believe a violation of these terms has occurred.

You retain all rights to your Input Photos. By uploading them, you grant us a limited, non-exclusive, royalty-free license to store, process, and transmit your Input Photos solely as necessary to provide the Service — specifically, to send them to OpenAI's image-edit API as generation references for your order.

You represent and warrant that you own all rights to every photo you upload, or that you have obtained all necessary permissions from any depicted individuals, and that uploading and processing those photos does not violate any third-party rights.

Your Input Photos are stored encrypted and deleted automatically 30 days after your Generated Images are delivered. You may request earlier deletion at any time by emailing hello@poselab.io.

Subject to your compliance with these Terms, you own the Generated Images produced for your order. You may use them for any lawful purpose, including commercial use (e.g., LinkedIn profiles, professional bios, press kits, marketing materials, and websites).

You grant us a limited, non-exclusive, royalty-free license to host your Generated Images for delivery purposes during the 30-day retention period. We will not use your Generated Images for marketing, advertising, or any public display without your separate written consent.

All content on the PoseLab website — including but not limited to the interface design, copy, software, and branding — is owned by or licensed to PoseLab. Nothing in these Terms transfers any of our intellectual property rights to you, except as expressly stated in Section 7 above.

The Service relies on the following third-party providers, each subject to their own terms and privacy policies:

• Stripe — payment processing
• OpenAI — AI image generation via the image-edit API. OpenAI says API data is not used to train or improve its models unless a customer explicitly opts in.
• Cloudflare R2 — encrypted image storage
• Resend — transactional email delivery
• Vercel — hosting and infrastructure

We are not responsible for the acts or omissions of these providers. Your use of the Service is also subject to any terms imposed by these third parties.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS WILL MEET YOUR SPECIFIC REQUIREMENTS.

AI-generated images are probabilistic and results vary. We make no guarantee that any Generated Image will be suitable for any particular professional or personal use.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID FOR YOUR MOST RECENT ORDER.

IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify, defend, and hold harmless PoseLab and its operators, officers, and affiliates from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your Input Photos or Generated Images; (c) your violation of these Terms; or (d) your violation of any third-party rights.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any conduct we reasonably determine violates these Terms or is harmful to us, other users, or third parties. Upon termination, your right to use the Service ceases immediately. Sections 6–12 survive any termination.

We may update these Terms from time to time. Material changes will be announced by updating the "Last updated" date above and, where practical, by posting a notice on the Service. Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the jurisdiction in which PoseLab is established. Any disputes arising from these Terms or the Service that cannot be resolved informally will be submitted to the exclusive jurisdiction of the courts of that jurisdiction.

If you are an EU consumer, mandatory consumer protection laws in your country of residence may provide you with rights that cannot be contractually waived. Nothing in these Terms limits those rights.

These Terms constitute the entire agreement between you and PoseLab with respect to the Service. If any provision is found unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision does not constitute a waiver of that provision. You may not assign any rights or obligations under these Terms without our prior written consent.
